The warranties set forth in this section 4.2 are intended solely for the benefit of Distributor.All claims hereunder shall be made by Distributor and may not be made by Distributor’s customers.The warranties set forth above are in lieu of all other warranties express or implied,which are hereby disclaimed and excluded by Wenger,including without limitation any warranty of merchantability or fitness for a particular purpose or use and all obligations or liabilities on the part of Wenger for damages arising out of or in connection with the use,repair or performance of the Products.
